Terms of Service

1. Acceptance of Terms

By downloading, installing, or using LingoArc ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Yoav Eliav ("Developer", "we", "us", or "our").

2. Description of Service

LingoArc is a language-learning application that uses spaced repetition (SM-2 algorithm) to help users build and retain vocabulary. The App offers:

  • Free tier: Core vocabulary learning features with local data storage, limited to 6 cards.
  • Premium tier: Unlimited cards, AI-powered word enrichment, speaking practice, and translation features.

3. User Accounts

The App uses Sign in with Apple for authentication. By signing in, you authorize us to create and maintain an account associated with your Apple ID. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. We reserve the right to terminate accounts that violate these Terms.

4. Premium Subscriptions

Premium access is available as an auto-renewing subscription purchased through Apple's App Store. By subscribing:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • You can manage and cancel subscriptions in your Apple ID account settings.
  • No refunds are provided for partial subscription periods, except as required by applicable law.

5. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the App.
  • Use the App for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to any systems or networks connected to the App.
  • Use the App to transmit any harmful, offensive, or disruptive content.
  • Resell, sublicense, or redistribute the App or its content.

6. Intellectual Property

All content, design, code, and materials within the App are the exclusive property of Yoav Eliav and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. No rights or licenses are granted except as expressly stated in these Terms.

7. User Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your data as described in the Privacy Policy. We use Firebase (Google) for authentication and cloud storage for premium users.

8. AI-Generated Content

LingoArc uses third-party AI services to generate word definitions, translations, examples, and speaking feedback. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. We make no warranties regarding the correctness of AI-generated content and encourage users to verify important information independently.

9. Third-Party Services

The App integrates the following third-party services. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

  • Firebase (Google) — authentication and cloud storage for premium users.
  • xAI (Grok) — primary AI provider for word enrichment, translation, image identification, and speaking feedback. Privacy policy: x.ai/legal/privacy-policy
  • Anthropic (Claude) — fallback AI provider used automatically when Grok is unavailable, for the same operations listed above. Privacy policy: anthropic.com/privacy
  • OpenAI (Whisper) — speech transcription for speaking practice sessions. Privacy policy: openai.com/policies/privacy-policy

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOAV ELIAV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER LOSSES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this document. Continued use of the App after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Israel. EU consumers may also have the right to bring claims in their country of residence.
